Правительство РФ приняло решение о проведении указанного эксперимента в целях борьбы с производством контрафактной продукции и защиты интересов добросовестных производителей и потребителей ювелирных и других изделий из драгоценных металлов и камней. Он будет осуществляться в период с 1 июня по 1 ноября 2018 года. Для юрлиц и ИП, проводящих операции с драгоценными металлами и камнями, включая добычу драгоценных камней в части сортировки, первичной классификации и первичной оценки участие в эксперименте будет добровольным, для этого им понадобится подать заявку в Минфин России. Также в нем будут участвовать Минкосвязь России, ФТС России, ФНС России, Росфинмониторинг (постановление Правительства РФ от 24 марта 2018 года № 3211).
Отмечается, что одной из целей эксперимента является апробация эффективности введения маркировки драгоценных металлов, драгоценных камней и изделий из них юрлицами и ИП, осуществляющими операции с драгоценными металлами и драгоценными камнями, для обеспечения контроля за их оборотом и подтверждения подлинности отдельных видов драгоценных металлов, драгоценных камней и изделий из них, а также их легального происхождения.
Кто вправе составлять административные протоколы по фактам нарушения правил обращения и учета драгоценных металлов, жемчуга, драгоценных камней или изделий, их содержащих? Для его проведения Минфин России, по согласованию с уполномоченными федеральными органами исполнительной власти, утвердит специальные методические рекомендации. В числе отдельных видов драгоценных металлов, драгоценных камней и изделий из них, которые будут маркироваться в порядке эксперимента:
несортированные алмазы; рубины, сапфиры и изумруды; серебро в необработанном виде; необработанная платина или в виде порошка; алмазы промышленные: необработанные или просто распиленные, расколотые или подвергнутые черновой обработке; алмазы непромышленные, необработанные или просто распиленные, расколотые или подвергнутые черновой обработке, которые могут быть использованы для изготовления бриллиантов; алмазы обработанные, но неоправленные или незакрепленные непромышленные (бриллианты); золото в прочих необработанных видах; монетарное золото; ювелирные изделия и их части из серебра, имеющего или не имеющего гальванического покрытия, плакированного или не плакированного другими драгоценными металлами.
